Terms & Conditions
RouteHold is an aid to navigation, not a substitute for your own attention, skill and judgment. Always obey traffic law and the actual road ahead, which take priority over anything the app shows or says. Do not touch your phone while riding. Maps and routes can be wrong: never follow guidance that is unsafe or unlawful.
The short version
- RouteHold helps you follow a route you planned. It is a riding aid, not a replacement for paying attention to the road.
- The road always wins. If the app and the real road or the law disagree, follow the road and the law.
- Maps, routing and directions come from third parties (Mapbox and OpenStreetMap) and can be wrong, out of date, or unsafe. You ride at your own risk.
- Routes you import are your own; RouteHold follows them as given and does not check them for safety or legality.
- The app is in beta and provided "as is", with no warranties.
- Nothing here removes rights the law does not allow to be removed, including for death or personal injury caused by negligence.
This summary is for convenience only. The full terms below are what apply.
1Who these terms are with
RouteHold ("the app") is provided by Chris Wild, an individual based in the United Kingdom ("I", "me" or "my"). These Terms and Conditions ("Terms") govern your use of the app. By downloading, installing or using RouteHold, you agree to these Terms. If you do not agree, do not use the app.
2Beta software
RouteHold is currently in beta testing. It is provided for evaluation, may contain errors or incomplete features, and may change, be interrupted, or be withdrawn at any time without notice. Features described on routehold.com or elsewhere are not guaranteed to be present or to work as described.
3Safety and your responsibility as a rider
3.1RouteHold is an aid to navigation only. It is not a substitute for safe riding, or for your own attention, road awareness, skill and judgment.
3.2You are responsible at all times for riding safely and lawfully and for the control of your motorcycle.
3.3Actual road conditions, road signs, road markings and traffic law always take precedence over any route, instruction, direction or information given by RouteHold. Where the app conflicts with the road ahead or the law, you must follow the road and the law, and must not follow the app.
3.4Do not hold, operate or interact with your phone while riding. Set up and check your route before you set off, and stop somewhere safe and lawful before making any change.
3.5Any speed, distance, time or limit shown is for information only. It does not replace posted speed limits or your duty to ride at a speed that is safe and legal for the conditions.
3.6Motorcycling carries inherent risks, including the risk of death, serious injury and damage to property. You are responsible for assessing your own skill and experience, your motorcycle and equipment, the weather, and the suitability and legality of any route, before and during every ride. You use RouteHold, and ride any route, at your own risk.
3.7Keep your phone adequately charged and securely mounted, and make sure that using it does not distract you from the road.
4Maps, routing and data accuracy
4.1The mapping, routing, directions and related data used in RouteHold are provided by third-party services, principally Mapbox, and rely on underlying data including OpenStreetMap. I do not create, control or independently verify this data.
4.2This data may be inaccurate, incomplete, out of date, or otherwise unsuitable. Roads may be missing, changed, closed or private; directions may be wrong; and surfaces, restrictions and conditions may differ from those shown. Guidance may route you in ways that are impractical, unsafe or unlawful.
4.3Routes you import into RouteHold (for example GPX or KML files that you create or obtain elsewhere) are your own. RouteHold follows the route as given and does not check it for accuracy, safety, suitability or legality. You are responsible for the routes you choose to ride.
4.4To the fullest extent permitted by law, I accept no responsibility or liability for any error, inaccuracy, omission or unsuitability in any map, route, direction or other data, or for any consequence of relying on it. Always ride according to the actual road and the law, not the app.
5No warranty
5.1RouteHold is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied or statutory, to the fullest extent permitted by law. This includes, without limitation, any implied warranties or conditions of satisfactory quality, fitness for a particular purpose, accuracy and non-infringement.
5.2I do not warrant that the app will be uninterrupted, timely, secure, error-free, or available at any particular time or location, or that any defects will be corrected.
6Limitation of liability
6.1Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded. In particular, nothing excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
6.2Subject to clause 6.1, and to the fullest extent permitted by law, I will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, income, data or goodwill, arising out of or in connection with your use of, or inability to use, RouteHold.
6.3Subject to clause 6.1, and to the fullest extent permitted by law, my total liability to you arising out of or in connection with the app, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the amount (if any) that you have paid to use RouteHold in the twelve months before the event giving rise to the liability. RouteHold is currently provided free of charge.
6.4If you are a consumer, you have legal rights that these Terms do not affect.
7Your responsibilities and acceptable use
7.1You must use RouteHold only in a lawful manner and in accordance with these Terms.
7.2You are responsible for your own device, its settings, how it is mounted, its power and its data connection, and for keeping your own files and routes backed up.
7.3You must not misuse the app, interfere with its operation or security, or use it in any way that is unlawful or that could harm others.
8Data and privacy
8.1To provide navigation, RouteHold uses your device's location and sends routing requests to Mapbox in order to generate and follow routes. Those requests are processed by Mapbox under its own terms and privacy policy.
8.2RouteHold asks only for the permissions it needs in order to navigate. How RouteHold handles your data, including the on-device debug logs it records during a ride while in beta, is explained in the Privacy Policy.
9Third-party services and content
9.1RouteHold depends on third-party services and data, including Mapbox and OpenStreetMap. Your use of features that rely on them may also be subject to those third parties' own terms. Map data is © Mapbox and © OpenStreetMap contributors.
9.2I am not responsible for third-party services, for their availability, or for the accuracy of their data.
10Intellectual property
The RouteHold name, logo and the app itself are owned by me or my licensors. These Terms do not transfer any rights in them to you, other than the limited right to use the app in accordance with these Terms.
11Changes
11.1I may update, change, suspend or withdraw the app or any of its features at any time.
11.2I may update these Terms from time to time. The current version will be published at routehold.com. If you continue to use the app after a change takes effect, you accept the updated Terms.
12Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or your use of RouteHold, are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in your home nation.
